One source of law in the United States is case law, sometimes called common law, which is based on the decisions of courts. The decision of a court resolves the dispute in the particular case that is in the court, but how can decisions of courts create a source of laws that apply beyond the case in which the decision was rendered?
In arbitration, the parties to the dispute select an independent arbitrator who hears evidence from both parties and decides how the dispute should be resolved. In civil litigation, a judge or jury hears the evidence from both parties and decides how the dispute should be resolved. What are the differences between arbitration and civil litigation? Why is one approach better than the other approach to resolving disputes?
Project planning
Throughout the duration of this course, you will be developing a project plan to present to your stakeholders. In order to make this a meaningful course, it is important that you select a project that aligns with your current work situation or a potential work environment that is of interest to you. Start thinking about the project that you may like to create a project plan for, and briefly describe it. Why are you considering this project? How do you feel the project will help prepare you to lead projects in the future? This will give your fellow students an idea of the types and scopes of projects being considered in this course as well as give them an opportunity to offer suggestions and comments about your project.
Think about a project you have worked on in the past. Was there a formal work breakdown structure (WBS) for this project? If so, what worked well? What did not? If there was not a WBS, how would an effective WBS have helped? Discuss with your classmates the benefits and limitations of WBS.

Critical thinking
Chapter 1 of our textbook explains the difference between an argument and an assertion. Give your own example of an assertion. Our textbook author states that assertions do “…little other than impart information.” Why do you think assertions should be true? In other words, why does truth matter?
As critical thinkers, we greatly benefit by determining what people assume. What people assume is not always said out loud. Briefly summarize a conversation that you recently had or have had in the past (note that this could also be a conversation that you heard). List at least two assumptions that were made during the conversations but were not said out loud. How did you know that these were assumptions (that they were taken for granted)? Were these assumptions true, or were they questionable? When do you think it is appropriate to point out that someone’s assumptions are false?
Read the following argument: I had a very long conversation with my neighbor yesterday. He is very friendly. His wife is also very nice. My neighbor updated me on what he has been doing and also on his future plans. One of his future plans totally shocked me! He is moving out of our middle class neighborhood. He has bought a 10-million-dollar mansion in Beverly Hills and will be moving there next month with his whole family. He is also going on a 6-month cruise after he is all moved in. He will travel the whole world in this cruise! It also surprised me that he had just bought a new $300,000 luxury automobile. He has always liked cars. It is very obvious that my neighbor is suddenly very wealthy.
